The Information and Data Protection Commissioner’s Office, in cooperation with the European Union Good Governance project, has drafted the Commentary “On the understanding and implementation of the law on open data and the reuse of information in the public sector”. The Commentary aims to facilitate the implementation of Law No. 33/2022 and serves as a practical guide for all public sector bodies or public undertakings to facilitate the understanding and interpretation of the new concepts that this law introduces, to explain how the legal obligations regarding open data and reuse will be fulfilled, as well as the mechanisms that will be used to protect, supervise and promote the right to reuse.
This act aims to help employees tasked with the publication of open data and the reuse of documents, as well as any other actor (business, civil society, media, citizens) directly or indirectly involved in this process, to better understand the rules applicable in concrete situations, with the ultimate goal of creating a functional system of open data and its reuse, in order to encourage innovation in the provision of products and services.
The drafting of this Commentary was preceded by a training of trainers (ToT) session on the effective implementation of the law on open data and the reuse of public sector information by experts from the European Union Good Governance project, followed by a roundtable discussion with the participation of representatives of public sector bodies and public enterprises. The issues identified during the discussions were included in the Commentary, with the aim of clarifying any aspect that is relevant in the implementation of Law No. 33/2022.
